1. Acceptance of Terms
Welcome to RightYacht. These Terms of Service (“Terms”) govern your access to and use of the RightYacht platform, website, and services (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
“You” refers to any individual or entity accessing the Platform, whether as a charter guest, yacht owner, broker, insurer, yacht manager, or other visitor.
2. Description of Services
RightYacht provides an independent yacht certification platform offering safety ratings, quality assessments, and related information for superyachts. Our services include, but are not limited to:
- Independent yacht safety and quality ratings
- Yacht listing pages with certification data and specifications
- Charter planning assistance through our AI-powered Captain Spyros assistant
- Certification services for yacht owners and operators
- Industry data and reports for B2B professionals
3. User Accounts
Certain features of the Platform may require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
4. RightYacht Ratings and Certifications
4.1 Independent Assessment
RightYacht ratings and certifications represent our independent professional assessment of yacht quality, safety, and condition at the time of evaluation. Ratings are produced using our proprietary methodology and scoring criteria, which we may update from time to time.
4.2 No Guarantee
Ratings and certifications are provided for informational purposes and are not a guarantee of safety, seaworthiness, condition, or fitness for any particular purpose. A RightYacht rating does not replace the need for your own due diligence, professional marine surveys, or compliance with applicable maritime regulations.
4.3 Point-in-Time Assessment
Yacht conditions can change after a rating is issued due to maintenance, modifications, wear, incidents, or other factors. Ratings reflect the state of the vessel at the time of assessment and may not reflect its current condition.
4.4 Use of Ratings
Certified yachts and their representatives may display their RightYacht rating in accordance with our brand guidelines. Misrepresentation, alteration, or fabrication of RightYacht ratings is strictly prohibited and may result in legal action. Uncertified parties may not use RightYacht ratings, logos, or certification marks without prior written authorisation.
5. Yacht Listing Information
Yacht specifications, images, and data displayed on our Platform are compiled from multiple industry sources and provided for informational purposes. While we endeavour to ensure accuracy, we do not warrant that all listing information is complete, current, or error-free. Users should independently verify critical specifications before making charter or purchase decisions.
6. Captain Spyros AI Assistant
Our AI-powered assistant, Captain Spyros, provides charter planning guidance and yacht recommendations. Responses generated by Captain Spyros are for informational and entertainment purposes and should not be relied upon as professional maritime, legal, or financial advice. RightYacht is not liable for decisions made based on AI-generated recommendations.
7. Intellectual Property
7.1 Our Property
The Platform, including its design, code, content, ratings methodology, scoring algorithms, certification marks, logos, and all related intellectual property, is owned by or licensed to RightYacht and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Platform without our prior written consent.
7.2 Limited Licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended purposes in accordance with these Terms.
7.3 User Content
By submitting content to the Platform (including yacht information, reviews, images, or communications), you grant RightYacht a worldwide, non-exclusive, royalty-free licence to use, display, reproduce, and distribute such content in connection with operating and improving the Platform.
8. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations
- Misrepresent, fabricate, or alter any RightYacht rating, certification, or data
- Scrape, harvest, or systematically extract data from the Platform without written authorisation
- Interfere with or disrupt the Platform’s infrastructure, security, or other users’ access
- Impersonate any person or entity or misrepresent your affiliation
- Use automated systems (bots, crawlers, scrapers) to access the Platform without our written permission
- Attempt to reverse-engineer our ratings methodology or scoring algorithms
- Use the Platform to transmit malware, spam, or other harmful content
9. B2B Services and Certification Programme
9.1 Certification Agreements
Yacht owners, managers, and operators seeking RightYacht certification may be subject to additional terms set out in a separate certification agreement. In the event of conflict between these Terms and a certification agreement, the certification agreement shall prevail for matters within its scope.
9.2 Professional Use
Brokers, insurers, and other industry professionals accessing the Platform for business purposes acknowledge that RightYacht data is provided for professional reference and does not constitute professional advice. Such users remain responsible for their own professional judgements and obligations.
10. Fees and Payments
Certain services, including yacht certifications and premium data access, may require payment. Fees, payment terms, and refund policies will be communicated at the time of purchase or in a separate agreement. All fees are non-refundable unless otherwise stated.
11. Disclaimer of Warranties
The Platform and all content, ratings, and services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, RightYacht disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components, or that any content or data will be accurate or reliable.
12. Limitation of Liability
To the maximum extent permitted by applicable law, RightYacht, its directors, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Platform, our ratings, or our services, regardless of the theory of liability.
Our total aggregate liability for any claims arising from or related to the Platform shall not exceed the amount you have paid to RightYacht in the twelve months preceding the claim, or one hundred euros (€100), whichever is greater.
13. Indemnification
You agree to indemnify, defend, and hold harmless RightYacht and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
14. Third-Party Links and Services
The Platform may contain links to third-party websites or services. We do not endorse or assume responsibility for any third-party content, privacy policies, or practices. Your interactions with third parties are solely between you and them.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Material changes will be communicated through the Platform or via email to registered users. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
16. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination shall survive, including intellectual property, disclaimers, limitation of liability, and indemnification.
17. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Hellenic Republic (Greece), without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
19. Entire Agreement
These Terms, together with our Privacy Policy and any applicable certification agreements, constitute the entire agreement between you and RightYacht regarding use of the Platform.
